Blacktail Mountain Adventures LLC (“BMA,” “Foundation,” “We,” “Us,” “Our”) is a tubing hill and activity center. We are firmly committed to online safety, including protecting your data and your personal information. Our goal is to provide the best possible experience for the participants, both in our great facilities and online. BMA provides this website as a tool for our participants to find key information, order tickets online, and provide an overall convenient experience

By using this website, you acknowledge and understand the Terms of Use (“Terms”) and the Privacy Policy below (which is incorporated by reference). Additionally, We may update, add, or refine the Terms, the Privacy Policy, or additional rules of operation, safety procedures, or other terms and conditions set forth by BMA from time to time by updating these Terms or posting a link to other terms and conditions. By accessing the Website, you agree to be bound by such revised terms as they are posted. Nothing in these Terms, the Privacy Policy, or any other terms and/or conditions shall be interpreted or understood to create, pledge, or promise any rights or benefits for third parties.

As stated in our Terms, by accessing the Website, you agree to this Privacy Policy.

  1. Collected Information. We collect the following information:
    1. Any information you provide, such as your name, the participants name, your child’s name if you are a Parent/Guardian, email address, mailing address, phone number, and any other information voluntarily surrendered or requested to BMA.
    2. Information that is voluntarily collected when you access the Website, such as your IP address, browser type and corresponding version, operating system, and other technical information.
    3. Information collected from third-party sources such as social media platforms and other public sources. 
    4. By using BMA facilities and services, you acknowledge and agree that BMA has the right to take photographs, videos, or take other images of the participants or activates taking place on or in its facilities in a conspicuous manner (collectively “Participant Pictures”). Under no circumstances shall BMA take pictures, videos, or other recording in areas of the facility where privacy is inherently expected, such as restrooms, locker rooms, showers, changing rooms/areas. Participant Pictures are for BMA’s own marketing, commercial, and social media purposes. If you wish to opt out of this provision, please contact us at the email address or phone number listed in Section 9.1 of the Terms. 
  2. Use of Information. BMA may use your information for various purposes, including without limitation:
    1. Providing you with services or information;
    2. Responding to your inquiry or request;
    3. Processing your donations, contributions, and/or other financial transactions;
    4. Sending newsletters, notices, updates, and other communications;
    5. Analysis and examination to better improve the Website, user experience, and our services overall;
    6. Personalizing your experience; and,
    7. Complying with applicable rules, regulations, laws, and/or ordinances.

    1. We do not, and pledge to not in the future, sell, rent, share, or otherwise disseminate you information for commercial purposes, with the exception of Participant Pictures governed by Section 1.4 above which will be used for the purposes described in that section.

      1. Service providers who perform functions and services on our behalf, such as and including without limitation, payment processing, mailing services, website hosting, and notification forwarding;
      2. Third parties when required by law, including without limitation, subpoena order, court order, or other legal process;
      3. Third parties in the event of a merger, acquisition, organizational change, or other internal business matter where your information may be transferred to a successor, parent, or purchasing entity.

    1. BMA is committed and dedicated to protection your privacy and will take any reasonable measures to ensure that your privacy and information are protected. 
    2. BMA implements appropriate technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, and/or destruction. 
    3. Despite BMA’s reasonable efforts to protect your privacy, no method or methods are completely secure and free from adulteration, and therefore, BMA expressly waives any representation or warranty that your information will remain 100% secure.

    1. You may, at your own discretion, request that we update or delete your personal information at any time by contacting us using the email address or phone number listed in Section 9.1 of the Terms. BMA will use all reasonable efforts to abide by your request. 
    2. You may unsubscribe from any newsletters or other communication by BMA by following the provided instructions included with such communication.

BMA may use cookies, web beacons, and other similar technologies to collect and store information about your visit to our website, improve your browsing experience, and personalize our content and services. As stated in the Terms, the Website is not intended to be used or accessed by children under 13 years of age, and BMA do not and will not intentionally collect personal information from children under 13 years of age. If BMA learn, discover, or are otherwise notified that information of a child under the age of 13 has been collected, BMA will take all reasonable measures to ensure that the respective personal information is subsequently deleted.
